Not trying to be racist here, but....
You see all these "other" nationality people driving around in expensive Mercs, BMW, Honda, really nicely done up Sports cars, etc, an you look at how they drive, and think to yourself MY GOD.
Today, I took out oneof these "other" nationality people.
An Asian "food delivery" van decided that a mere 2 - 4 meters was enough to merge while people where going past at 60km/h. Sadly, it was me he pulled out in front of, no indcator, nothing to show for it other than "free lane, full lane".
I hit the brakes, locked the wheels and prayed I would stop, but nope, there was a pretty heavy impact.
Got out, I have a busted headlight (glass is fine, the rear mounts are broken), a torn bumper (but all in one piece), and also a bent headlight mount on the chassis (it's easily bent back, and there is no other damage).
The damage to him, his back door doesn't close and lock (a VAN remember), his rear bumper is stuffed an almost off, and when I hit the exhaust pipe, it broke his engine mount, so the moto is almost on the ground now.
This moron was very quick to NOT want to exchange details, but I took his plate down anyway and notified the authorities anyway.
Later on I get a call, the driver was NOT licenced, was NOT insured, and they have charged him as he nt into a station to complain I hit him and ran from the scene. (When I made the phone call, my tires where still sitting on the skid marks, and a passing police car was able to verify I WAS still on the scene, but knowbody else was).
This moron is probably not going to be paying damages (I know I hit him from behind, but being unlicenced/unregistered, he is immediately at fault), but this is an excuse for a front bodykit now, and it wont be hard to fix the rest, a new headlight, and a little panel work on th bonnet again, but it wont be to bad I think.

He has an engine about to fall out and a back door that won't seal on a food delivery van.
Beside that it sounds like the wholopers have all but thrown the book at him. I hope your insurance company finishes the job with a full cavity search on him and his company :twisted: You could call the tax dept. to finish the job, that would be nasty :twisted:

i hate to say, but if you hit someone in the rear you are at fault. even if he was drunk aswell, you are still at fault as far as insurance is concerned. him being unlicenced etc is a police matter and has nothing to do with the accident. from working 2.5 years in insurance claims, 99.99% of the time the person hitting someone in the rear is at fault.
but like you said, accidents are great opportunities to play with the car ;)

^ thats a real worry. So basically you can be a reckless unlicensed git, merge into a 60km/hr lane doing 15km/hr, cause an accident due to the simple laws of physics, and get away with it???

unfortunately yes.
the only time where a hit in the rear is the person in front's fault is if the damage is on an angle suggesting they merged. the reason why this very very rarely happens is because by the time you see them merge, jump on the brakes then hit them, they are already completely in your lane and you hit them square.
hell one time this git cut me off and i got rather peeved. so i sped up, jumped in front of him and hit the brakes. bang. totally my fault (ie if i didnt be a noggin there would have been no accident), however my ex had already damaged the rear bumperbar and this was a good way to get it fixed for free ;) hehehe

But the piggily wigglies have a record of the dumb ass doing the wrong thing.
I'll be interestd to see what happens at the end of the day. (insurance companies don't like to pay out)

Insurance wont be paying, the excess for me to claim is $1700, the cost of repairs (even with a brand new bonnet from the smash repairs, and a complete fron end paint) will cost no more than about $700 - $1,000.
I have spoken to the insurance company, and they have a written report from the Police stating who was at fault even though I was the person that "seemed" to be in the wrong, they Insurance have agreed with Police and under the circumstances, are going saying it's a "not at fault" accident.
either way, it's upgrade time :)

you'll be suprised how many times the insurance co's classify the the other person at fault compared to the police..
do you have comprehensive insurance? if your ins co says the other person is at fault, why are you not claiming through them? some insurance companies allow you to claim through them when you're not at fault and they chase the other person AND you pay no xs. i know with suncorp we dont charge xs, no effect to rating and your car gets fixed and suncorp chases the other person for the money. i know for sure that aami still increase your rating no matter what you claim for through them, even if it's not your fault.

unfortunately the rules are the same across the globe when it comes to insurance claims, if some moron pulls out in front of you off a slip road, and he/she is doing half the speed of the moving traffic "apparently" you are at fault for not "paying attention to the road conditions"- even though it's a two lane carriageway and you are indicating to change lane to let the so called "merger" into the freeway and you have independant witnesess to back you up.
unless you have photographic/police or video evidence to back up your claim insurance companies will never pay up.
never trust insurers, they only want your money and not your time(sorry twilightprotege) but they are all money grabbing hypocritical "bankers"

serious :shock: so what did you say your reason was for slammin on the brakes? does it matter? how about there was a cat in the middle of the road? this has potential!

well once the insurance said you are not at fault, you will not be liable for excess, if in case later the other party denied and even put the matter up in court and you lose, you still not liable for excess, it's only insurance company loses.

yep serious. the other guy had no come-back because he hit me square in the rear. claim lodged that arvo, in for repairs the next day. helps when you know ppl and the process ;)

Damn!! Yea.. that sucks!
Hopefully, it works out for ya there! I had a similar thing, but it was a hit on the side/front on me, so not my fault... but then the guy changed the story to say that I was merging into him! its been over a year! and its still unresolved!

good to see you are looking at the positives.
I have had being at the rear and not at fault work once, first accident I was at the rear and put at fault. I hit a coal truck going down a steep hill doing 40 and I was doing 80. pulled in the left lane going around a long sweeping blind corner to try and do the right thing and keep peace with the speeding drivers, didn't work though, ended up making my Laser a foot shorter. 2nd one where I wasn't at fault a truck changed lanes without looking and came in my lane.
hope its all fixed soon.

and yes as andy said, if your not at fault then you should put the claim to your insurance company, that is unless your doing a dodgy (wouldn't surprise me)

After about two months I am almost finished with my Hail claim only 5 outstanding things to fix. (Hail storm on Fathers day)
AAMI passed that buck along in every way they could,
Finishing my claim, booking into that course they offer sound like fun, and then giving them a big smile and the finger.
MY Advise see if you can get money to pay for repairs not actual repairs. And then use the money to go a place you know.
I paid an extra portion to make a partial respray into a full one,
I would advise you do NOT do the same ie half insurance half your pocket. make them seperate.
if you want my full story it shall be in bookstores early next year entitled "Are you F$*#ing Kidding me" A guide to smash repairs done by dummies.
basically I would keep the two as seperate as possible.
they have done all of the insurance work to a fairly decent degree, and could not of done a worse job on my private stuff,
Cost and duration up like 90% of quoted but I am stuck there due to the insurance claim but AAMI will not help as the work is private,
Heed my warning,
In fact I might call them and tell them off again, as I just recalled they said I had to go to that place even after he screwed me the first of 4 times.
